Hallo – ich habe in Graz eine Zimmer gemietet mit Ofen, aber der Vertrag sagt miete is kalt. Der Ofen geht nicht mehr. Vermieter sagt, ich bin verantwortlich zu heizen. Und neue ofen kaufen. Bitte um hilfe, was ist richtig? Danke fur Hilfe.

Hallo Mehmut - grundsätzlich heisst, der Vertrag Miete kalt, dass Du selber für das Heizmaterial aufkommen musst. Das heisst du musst das Öl, das Holz, etc. kaufen. Falls der Ofen schon in der Wohnung war und dir gesagt wurde, dass er funktioniert, dann ist es die Pflicht des Vermieters diesen wieder zu reparieren.

Ich weiss nicht, wo Du bist, aber geh zu einer Rechtsberatung. Solche gibt's oft kostenfrei in Graz und Wien. Vielleicht auch am Magistrat nachfragen. Du hast auf jeden Fall Recht auf eine funktionierende Heizanlage. Das heisst der Ofen muss funktionieren. Das Holz musst Du selber kaufen.
